Grounds for exclusion
Corruption: An economic operator referred to in Article 108(1) shall be excluded from the procurement procedure. 1 points 1 and 2 of the Public Procurement Act. In accordance with Article 7 of the Act of 13 April 2022 on special solutions to counteract the support for aggression against Ukraine and to protect national security, the Contracting Authority will exclude from the public procurement procedure conducted on the basis of the Act of 11 September 2019 – Public Procurement Law: an economic operator included in the lists provided for in Regulation (EC) No 765/2006 and Regulation (EU) No 269/2014 or entered on the list on the basis of a decision on inclusion on the list determining the application of an exclusion measure from public procurement procedures; b) an economic operator whose beneficial owner within the meaning of the Act of 1 March 2018 on the prevention of money laundering and terrorist financing is a person listed in the lists set out in Regulation (EC) No 765/2006 and Regulation (EU) No 269/2014 or entered on the list or being such a beneficial owner from 24 February 2022, provided that it has been entered on the list on the basis of a decision on entry on the list deciding on the application of an exclusion measure from public procurement procedures; (c)an economic operator whose parent undertaking within the meaning of Article 3(3) is: Point 1(37) of the Accounting Act of 29 September 1994 is an entity listed in Regulation (EC) No 765/2006 and Regulation (EU) No 269/2014 or entered on the list or being such a parent company since 24 February 2022, provided that it has been entered on the list on the basis of a decision on entry on the list deciding on the application of an exclusion measure from public procurement procedures. 3. Pursuant to Article 5 k par. Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine OJ L 229, 31.7.2014, p. 1 – as amended],: It shall be prohibited to award or continue to perform any public contract (...) falling within the scope of the Public Procurement Directives (...) for or with: Russian nationals or natural or legal persons, entities or bodies established in Russia; legal persons, entities or bodies whose proprietary rights are directly or indirectly owned for more than 50 % by an entity referred to in point (a) of this paragraph; or (c) natural or legal persons, entities or bodies acting on behalf or at the direction of an entity referred to in points (a) or (b) of this paragraph, including subcontractors, suppliers or entities whose capacities are relied upon within the meaning of the Public Procurement Directives, where they account for more than 10 % of the value of the contract.
