2.2) For each of the above-mentioned persons, a copy of a valid security clearance or written authorization authorising access to classified information classified as restricted and a copy of a current certificate confirming training in the protection of classified information must be submitted;
3.1) In the case of joint bidders, the fulfilment of the condition will be assessed cumulatively.
1. The procedure is conducted in accordance with the provisions of Chapter 4a of the Public Procurement Act - Procurement in the fields of defence and security, under a restricted tender procedure.

2. The Contractor is obliged to submit a request to participate in the procedure, drawn up in accordance with the model constituting Annex 1 to the notice published on the contracting authority's website: http://www.strazgraniczna.pl

3. The assessment of compliance with the conditions for participation in the procedure will be made in accordance with the formula "compliant/non-compliant" based on the information contained in the statements and documents specified in this notice.
4. The application must be written in Polish (pursuant to Art. 2 Acts) on a typewriter, computer or other durable and legible technique and signed by the person(s) authorised to represent the Contractor.
5. Along with the application, within the time limit specified in Section IV.3.4, the following must be submitted:
1. the declarations and documents required by Sections III.2.1 and III.2.3;
2) power of attorney in the case of appointment of proxies.
6. Declarations and documents must be signed by the person(s) authorised to represent the Contractor.
7. The request, statements and documents for which the templates contained in the annexes to the notice published on the website have been specified, the Ordering Party recommends to fill in according to the requirements contained therein, without making changes to their content.
8. Declarations concerning the Contractor and other entities on whose professional capacity the Contractor relies pursuant to Article 22a of the Public Procurement Act and documents referred to in Section III.1.3 para. 3, should be filed in the original.
9. Powers of attorney should be filed in the original or a notarized copy.
10. Other documents may be submitted in the original or in a certified copy by the Contractor or the entity on whose professional capacity the Contractor relies, respectively, or by Contractors jointly applying for the award of a public contract in respect of documents relating to each of them.
11. The attestation should be made in such a way as to enable the person who carried out the attestation to be identified (e.g. with the personal stamp of the person certifying the copy of the document as being in conformity with the original).
12. The contracting authority recommends that each page of the application (together with the attachments to the application) be numbered consecutively, and that the application and its attachments be combined in such a way that it cannot be self-completed (without the participation of third parties) and that its content cannot be changed without visible traces of infringement (e.g. the entire application may be laced by the contractor, and the ends of the cord permanently secured or sewn all pages, at least, into two staples, etc.).
13. Any amendment or amendment to the content of the proposal (including its annexes) must be initialled (or signed) by the person(s) empowered to make the amendment or amendment. The initial (signature) should be affixed in such a way that the signature can be identified (e.g. together with the personal stamp of the person submitting the initial).
14. Documents drawn up in a foreign language must be submitted together with a translation into Polish.
15. The Contracting Authority informs that in accordance with Article 8 in conjunction with Article 96 para. 3 of the Public Procurement Act, applications submitted in public procurement proceedings shall be public and shall be made available from the date of notification of the results of the assessment of compliance with the conditions for participation in the procedure, with the exception of information constituting a trade secret within the meaning of the Act of 16.4.1993 on combating unfair competition (Journal of Laws No. Journal of Laws 2003, No 153, item 1503, as amended), if the Contractor, within the deadline for submitting applications, stipulated that they could not be made available and at the same time demonstrated that the proprietary information constituted a trade secret.
16. The Contractor has the right to reserve information constituting a trade secret within the meaning of the provisions on combating unfair competition (e.g. in the application form). In accordance with Art. 3 of the Public Procurement Act, information constituting a trade secret within the meaning of the provisions on combating unfair competition shall not be disclosed if the Contractor, no later than at the time of submitting the application, stipulates that it cannot be made available and has demonstrated that the proprietary information constitutes a trade secret. The Contracting Authority recommends that proprietary information, as a trade secret, be submitted by the Contractor in a separate internal envelope marked "trade secret", or fastened (sewn) separately from other non-confidential elements of the request to participate in the procedure. The absence of a clear indication as to which information constitutes a trade secret will mean that all submissions and certificates made in the course of these proceedings are unreservedly public.
17. Contractors shall bear all costs relating to the preparation and submission of the application.
Place and method of submitting applications:
18. The application for the lots selected by the Contractor, together with all signed annexes, must be placed in an envelope sealed in such a way as to preserve the confidentiality of its contents and to safeguard its integrity.
19. The envelope is to be addressed (exact name and address of the Ordering Party) and described according to the following formula:
Border Guard Headquarters, Finance Office – Public Procurement, Procedure No 60/BF/BŁiI/17 – Request to participate in the procedure entitled ‘Construction of the National PNR Component. Purchase of hardware and software infrastructure for PNR and assistive systems – Phase 1 – Part II purchase of standard software licences for hardware and software infrastructure and specialised programming libraries’.
20. In addition to the above marking, the envelope should bear the exact name and address of the Contractor.
21. The application should be submitted to the Office of the KGSG Finance Office in Warsaw at ul. Officer Cadets 38, building No. 5, room No. 118, at 7 p.m. 8.30 – 15.30 (Monday to Friday), contact phone – on the city line: +48 22 5004372 or +48 22 5004436, from the badge office – on the departmental line 76604372 or 76604436.
22. The Contractor (on request) will receive written confirmation of the request.
23.The consequences of submitting an application contrary to the above description (e.g. treating the application as ordinary correspondence and not delivering it to the place of submitting applications within the deadline specified in the notice) shall be borne by the Contractor.
24. The Contractor may amend or withdraw the application submitted before the deadline for submission of applications.
25. The Contracting Authority shall immediately notify the Contractor whose request is received after the deadline specified in Section IV, point 3.4. The Ordering Party shall return the application after the expiry of the time limit for filing an appeal.
26. The Contracting Authority shall allow the following means of communication with the Contractors:
1) via the postal operator within the meaning of the Act of 23.11.2012 - Postal Law (Journal of Laws of 2012, No. U. pos. 1529 and 2015, item 1830), personally or through a messenger;
2) by fax, at +48 22 500 47 07, +48 22 500 47 82.
27. The contracting authority may change the content of the notice before the deadline for submitting applications. Any change made will become an integral part of this announcement.
28. Information for Contractors (downloadable in electronic form) concerning the preparation of the request to participate in the procedure, together with specimen documents, can be found on the Contracting Authority's website in the section concerning this procedure.
29. The Ordering Party reserves the right to request the presentation of the original or a notarized copy of the document if the submitted copy of the document is illegible or raises doubts as to its veracity.
30. Pursuant to Article 93 para. 1a of the Public Procurement Act, the Contracting Authority may cancel the procurement procedure if the funds from the European Union budget and non-reimbursable funds from aid granted by Member States of the European Free Trade Agreement (EFTA), which the Contracting Authority intended to use to finance all or part of the contract, have not been awarded to it.
31. The start date of the order given in point. II.3 is an indicative date.
